Once a process has been initiated in accordance with the rules of this Title, as soon as it appears that the fact is not included in any of the assumptions of article 757, it will continue in accordance with the general provisions of this Law, without going back in the procedure except in in the event that it is necessary to carry out proceedings or carry out actions in accordance with said legal precepts. On the contrary, once a process has been initiated in accordance with the common rules of this Law, its substantiation will continue in accordance with those of this Title as soon as it is established that the fact prosecuted is included in one of the assumptions of article 757. In both cases the change of procedure will not imply that of instructor.
A process has been initiated in accordance with the rules of this Law, as soon as it appears that the act could constitute a crime whose prosecution is within the jurisdiction of the Jury Court, the provisions of the article 309 bis.
Once the Judge or Court has agreed on the procedure to be followed, the Judicial Secretary will immediately inform the Public Prosecutor's Office, the person under investigation and the parties in person.
