Article 644 of the Criminal Procedure Law

When the Court finds the request of the Public Prosecutor inadmissible regarding the dismissal and there is no private plaintiff supporting the action, before agreeing to the dismissal, you may determine that the case be sent to the Prosecutor of the respective Territorial Court if it is continued in a criminal Court, or to the Supreme Court if it is substantiated before a territorial Court , so that, knowing the result, one or another official can decide whether or not to sustain the accusation. The consulted Prosecutor will bring the resolution to the attention of the consulting Court, with return of the case.
