The Courts and Tribunals will order the practice of chemical analyzes only in cases in which they consider them absolutely essential for the necessary judicial investigation and the proper administration of justice.

Whenever there are proven reasons that justify it, the Investigating Judge may agree, in a reasoned resolution, to obtain biological samples from the suspect that are essential for determining his DNA profile. To this end, it may decide to carry out those acts of inspection, recognition or physical intervention that are appropriate to the principles of proportionality and reasonableness.
