Article 269 of the Criminal Procedure Law

Formalized to be the complaint, the Judge or official who is responsible for verifying the fact reported will immediately proceed or order the proceeding, unless it does not have the character of a crime, or the complaint is manifestly false. In either of these two cases, the Court or official will abstain from any procedure, without damage of the liability they incur if they improperly reject it.
