The soldier who commits any of the crimes provided for in articles 368 to 371 of the Penal Code in facilities affecting the Armed Forces or the Civil Guard, warships, Civil Guard vessels, military aircraft, camps or during exercises or operations, will be punished with the penalties established therein increased by one fifth of its maximum limit, unless the place of commission or the authority or official status of the active subject of the crime have been taken into account by the aforementioned Code when describing or punishing the crime. All this without damage of the application of article 21 of this Code.

The Military Courts will also be applicable articles 372 to 378 of the Penal Code.
