1. The soldier who in the exercise of command arbitrarily exceeds his faculties or, taking advantage of his employment, position or destination, commits any other serious abuse will be punished with a sentence of three months and one day to two years in prison. If you use or order unnecessary violence against any person or order, allow or make illegal use of weapons, you will be punished with four months to four years in prison. All this without damage, where appropriate, of the corresponding penalty for the harmful results produced, in accordance with the Penal Code.
2. The penalty of three months and one day to one year in prison will be imposed on the soldier who improperly and maliciously assumes or retains a command or assignment.
