Article 573 bis of the Penal Code

1. The terrorist crimes referred to in section 1 of the previous article will be punished with the following penalties:

  1. With imprisonment for the maximum time provided for in this Code if the death of a person is caused.
  2. With a prison sentence of twenty to twenty-five years when, in cases of kidnapping or illegal arrest, no reason is given for the person's whereabouts.
  3. With imprisonment of fifteen to twenty years if an abortion of the article 144, injuries of those typified in the articles 149, 150, 157 either 158, the kidnapping of a person, or havoc or fire of those provided respectively in the articles 346 and 351.
  4. With imprisonment of ten to fifteen years if any other injury is caused, or a person is illegally detained, threatened or coerced.
  5. And with the penalty provided for the crime committed in its upper half, being able to reach the highest in degree, when it concerns any other of the crimes referred to in section 1 of the previous article.

2. The sentences will be imposed in their upper half if the acts are committed against the people mentioned in section 3 of the article 550 or against members of the Security Forces or Corps or the Armed Forces or against public employees who serve in penitentiary institutions.

3. The terrorist crimes referred to in section 2 of the previous article will be punished with a penalty higher in degree than that respectively provided for in the corresponding articles.

4. The crime of public disorder provided for in the article 557 bis, as well as the crimes of rebellion and sedition, when committed by a terrorist organization or group or individually but covered by them, will be punished with a penalty higher in degree than those provided for such crimes.
