Article 557 bis of the Penal Code

1. The acts described in the previous article will be punished with a sentence of one to six years in prison when any of the following circumstances occur:

  1. When any of the participants in the crime carries a weapon or other dangerous instrument, or exhibits a simulated firearm.
  2. When the act of violence carried out is potentially dangerous for people's lives or can cause serious injuries. In particular, the cases of throwing blunt objects or flammable liquids, fire and the use of explosives are included.
  3. When the events take place in a demonstration or large meeting, or on the occasion of any of them.
  4. When acts of looting are carried out.
  5. When the author of the act takes advantage of his status as an authority, agent thereof or public official.
  6. When they are carried out with the face hidden and thus making the identification of their authors difficult.

These penalties will be imposed without damage of those that could correspond to the specific acts of violence, threats or looting that had been carried out.
