1. Those who, in contravention of laws or other general provisions, collect, transport, valorize, transform, eliminate or use waste, or do not adequately control or monitor such waste, will be punished with the penalties provided for in the previous article, in their respective cases. activities, such that they cause or may cause substantial damage to the quality of air, soil or water, or to animals or plants, death or serious injury to people, or may seriously harm the balance of natural systems.
2. Whoever, outside the case referred to in the previous section, transfers a non-negligible amount of waste, both in the case of one or several shipments that appear linked, in any of the cases referred to in the Law of the European Union regarding waste shipments, will be punished with a sentence of three months to one year in prison, or a fine of six to eighteen months and special disqualification from profession or trade for a period of three months to one year.
