2. In the case of public commercial companies that implement public policies or provide services of general economic interest, only the penalties provided for in letters a) and g) of section 7 of the article 33. This limitation will not be applicable when the judge or court determines that it is a legal form created by its promoters, founders, administrators or representatives with the purpose of avoiding possible criminal liability.
