Will be punished with a prison sentence of one to four years:

1. Whoever, falsely attributing to himself the power of disposition over a movable or immovable thing that he lacks, either because he has never had it, or because he has already exercised it, alienates, encumbers or leases it to another, in damage from this one or from a third party.

2. Anyone who disposes of a movable or immovable thing hiding the existence of any charge on it, or who, having disposed of it as free, encumbers it or alienates it again before the definitive transfer to the acquirer, to the detriment of the latter, or from a third party.
