3. The penalties indicated in the previous sections will be imposed in their upper half when the offender uses weapons or other equally dangerous means, either when committing the crime or to protect the escape, and when he attacks those who come to the aid of the police. victim or those who persecute him.

4. Taking into account the lesser nature of the violence or intimidation exercised and also assessing the remaining circumstances of the incident, a lower penalty than that provided for in the previous sections may be imposed.
