1. The abandonment of a minor or a person with a disability in need of special protection by the person in charge of their guardianship, will be punished with a prison sentence of one to two years.
2. If the abandonment were carried out by the parents, guardians or legal guardians, a prison sentence of eighteen months to three years will be imposed.
3. A prison sentence of two to four years will be imposed when, due to the circumstances of the abandonment, the life, health, physical integrity or sexual freedom of the minor or the person with a disability in need of special protection has been put in particular danger, without damage to punish the act accordingly if it constituted another more serious crime.
