1. To proceed with the crimes provided for in this Chapter, it will be necessary complaint of the aggrieved person or his legal representative.

2. The complaint required in the previous section will not be necessary to proceed with the facts described in article 198 of this Code, nor when the commission of the crime affects the general interests, a plurality of people or if the victim is a person. a minor or a person with a disability in need of special protection.

3. The forgiveness of the offended party or his legal representative, if applicable, extinguishes the criminal action without damage of the provisions in the article 130.1.5.º, second paragraph.

Article 201 refers to the general need to record a complaint of the aggrieved person to proceed through the crimes of revealing secrets.

Following the update published on 06/05/2021 that enters into force on 06/25/2021, article 201 is modified by final provision 6.26 of Organic Law 8/2021, of June 4. Previously, he said the following:

1. To proceed with the crimes provided for in this chapter, a complaint from the aggrieved person or their legal representative will be necessary. When the person is a minor, a person with a disability in need of special protection or a helpless person, the Public Prosecutor's Office may also file a complaint.

2. The complaint required in the previous section will not be necessary to proceed with the facts described in article 198 of this Code, nor when the commission of the crime affects the general interests or a plurality of people.

3. The forgiveness of the offended party or his legal representative, if applicable, extinguishes the criminal action without prejudice to the provisions of the second paragraph of number 5 of section 1 of article 130.
