1. The authority or public official who, abusing his position, commits torture in order to obtain a confession or information from any person or to punish him for any act he has committed or is suspected of having committed, or for any reason based in any type of discrimination, subjects her to conditions or procedures that, due to their nature, duration or other circumstances, cause physical or mental suffering, the suppression or diminution of her powers of knowledge, discernment or decision or that, in any other way, violate their moral integrity. Anyone guilty of torture will be punished with a prison sentence of two to six years if the attack is serious, and a prison sentence of one to three years if it is not. In addition to the aforementioned penalties, in any case, the penalty of absolute disqualification of eight to 12 years will be imposed.

2. The same penalties will be incurred, respectively, by the authority or official of penitentiary institutions or centers for the protection or correction of minors who commits, with respect to detainees, inmates or prisoners, the acts referred to in the previous section.
