Article 166 of the Penal Code

1. The convict of illegal arrest or kidnapping that does not give an account of the whereabouts of the detained person will be punished with a prison sentence of ten to fifteen years, in the case of illegal detention, and fifteen to twenty years in the case of kidnapping.

2. The act will be punished with a sentence of fifteen to twenty years in prison, in the case of illegal detention, and twenty to twenty-five years in prison, in the case of kidnapping, when any of the following circumstances occur:

a) That the victim was a minor or a person with a disability in need of special protection.

b) That the author had carried out the illegal detention or kidnapping with the intention of attacking the freedom or sexual indemnity of the victim, or had subsequently acted with that purpose.
