Article 143 of the Penal Code

  Penal Code

1. Whoever induces the suicide of another will be punished with a prison sentence of four to eight years.

2. A prison sentence of two to five years will be imposed on anyone who cooperates with acts necessary to the suicide of a person.

3. Will be punished with a prison sentence of six to ten years if the cooperation reaches the point of executing death.

4. Anyone who causes or actively cooperates with necessary and direct acts to the death of a person suffering from a serious, chronic and disabling condition or a serious and incurable illness, with constant and unbearable physical or mental suffering, by express, serious request and unequivocal of this, will be punished with the lower penalty in one or two degrees to those indicated in sections 2 and 3.

5. Notwithstanding the provisions of the previous section, it will not incur in criminal liability whoever causes or actively cooperates in the death of another person complying with the provisions of the organic law regulating euthanasia.

This article refers to those who induce or collaborate in the suicide of a person, and the corresponding prison sentence.

In addition, in section 5 (added in the last update of the Penal Code) it is indicated that whoever causes or actively cooperates in the death of another person does not incur criminal responsibility, complying with the provisions of the organic law regulating euthanasia.

Previously, article 143 before the update of 03/25/2021, said the following:

1. Whoever induces the suicide of another will be punished with a prison sentence of four to eight years.

2. A prison sentence of two to five years will be imposed on anyone who cooperates with acts necessary to the suicide of a person.

3. Will be punished with a prison sentence of six to ten years if the cooperation reaches the point of executing death.

4. Whoever causes or actively cooperates with necessary and direct acts to the death of another, at the express, serious and unequivocal request of the latter, in the event that the victim suffered a serious illness that would necessarily lead to his death, or that produces serious permanent suffering and difficult to bear, will be punished with a penalty one or two degrees lower than those indicated in numbers 2 and 3 of this article.
